Terms of Service
This is a working draft. It reflects the prices and plans shown on our site today and is waiting on review by our attorney before it takes effect. Items marked Counsel are still being settled. Nothing has been sold yet, and no payment is taken under this draft.
The short version
- A Den Screen is $379 (16-inch) or $529 (22-inch), and your first year of Den Family is included.
- Try it at home for 120 days. Not for your family? Send it back for a full refund.
- After the first year, Den Family is $129 a year or $229 for two years. We email you 14 and 7 days before it renews, and you can cancel from the app at any time.
- If you stop paying, your Screen never goes dark. It moves to the Free Tier and keeps the schedule, chores, quests, points and Calm Corner.
- The Den is for grown-ups to set up and families to use at home. It is not for resale or for anything that could harm a child.
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Digital Den Studios, LLC, a Georgia limited liability company ("Digital Den Studios," "we," "us"). They cover the Den Screen wall display (the "Screen"), the grown-ups companion app on the web and in app stores (the "App"), the Den Family subscription, and the pages at digitalden.studio/theden (the "Site"). Together we call these "The Den."
By buying a Screen, creating a family account, or using The Den, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use The Den.
2. Who can use The Den
You must be at least 18 years old and able to enter a contract to buy a Screen or create a family account. The grown-up who creates the family is responsible for the household's use of The Den, including anything entered about children and anything other grown-ups in the family do.
Children use the Screen in the home under a grown-up's supervision. Children do not agree to these Terms and never hold an account.
The Den is sold and supported in the United States only.
CounselConfirm U.S.-only sales for launch and whether any states should be excluded.
3. Buying a Den Screen
Current prices, in U.S. dollars, before any sales tax:
| Item | Price | Includes |
|---|---|---|
| Den Screen 16 | $379 | One 16-inch Screen and your first year of Den Family |
| Den Screen 22 | $529 | One 22-inch Screen and your first year of Den Family |
| Extra Den Screen 16 | $329 | Hardware only, for a family already on Den Family |
| Extra Den Screen 22 | $479 | Hardware only, for a family already on Den Family |
A family can run up to three Screens on Den Family. Prices may change, but a price change never affects an order you have already placed.
Payment is taken by our payment processor, Stripe, at checkout. We will collect sales tax where the law requires it, and the tax is shown before you pay. Your order is accepted when we email you a receipt. We may cancel an order and refund it in full if the price was listed in error, the item is out of stock, or we cannot verify the payment.
Each Screen is sold with one year of Den Family for the family that registers it. That year starts on the day you register your family account, or 30 days after delivery, whichever comes first.
CounselConfirm the Extra Screen 22 price ($479 is provisional), the sales-tax registration (Georgia number pending), and the rule for when the included year starts.
4. Shipping and delivery
We ship to addresses in the United States. Shipping is included in the price unless checkout says otherwise. We will email you when your Screen ships, with tracking. Delivery dates are estimates. Your Screen becomes yours, and the risk of loss passes to you, when the carrier delivers it to the address you gave us.
If your Screen arrives damaged, email us within 14 days with a photo and we will replace it at no cost.
CounselConfirm shipping terms (included or charged), who bears risk of loss in transit, and the damaged-on-arrival window.
5. The 120-day refund guarantee
Hang it, use it, and see if it fits your family. If it does not, you have 120 days from the day your Screen is delivered to send it back for a full refund of what you paid, including the first year of Den Family and any sales tax.
To start a return, email hello@digitalden.studio from the email on your account. We will send you a prepaid shipping label. Pack the Screen, the mount and the power cord in the original box if you still have it. Normal wear from four months on the wall is fine; we only ask that the Screen comes back complete and working. Once it arrives, we refund the original payment method within 10 business days and your family moves to the Free Tier (or is deleted, if you ask).
Extra Screens have the same 120-day guarantee. The guarantee covers one return per Screen.
CounselConfirm who pays return shipping, what condition is required, whether a restocking fee ever applies, and the refund timeline. This section is the consumer-facing version of the guarantee on the Site and must match it.
6. Den Family and automatic renewal
Den Family is the subscription that keeps every feature of The Den switched on: feelings check-ins, notes, the rewards store, team quests, morning and evening routines, the full Dressing Room, up to three Screens, and automatic software updates.
| Den Family term | Price | Renews |
|---|---|---|
| 1 year | $129 | Every 12 months |
| 2 years | $229 | Every 24 months |
| Monthly | $12.99 | Every month |
Automatic renewal
When your included first year ends, and at the end of each term after that, Den Family renews automatically for the same term at the then-current price, and we charge the payment method on file. By keeping a payment method on your account you authorize these charges.
We will email the grown-ups on your account 14 days and again 7 days before each renewal, telling you the amount, the date, and how to cancel. If a renewal payment fails, we will email you and retry for up to 14 days before your family moves to the Free Tier.
Canceling
You can cancel Den Family at any time in the App under Account, or by emailing hello@digitalden.studio. Canceling stops the next renewal. You keep Den Family until the end of the term you have already paid for, and then your family moves to the Free Tier. We do not give partial refunds for unused time, except under the 120-day guarantee above.
Price changes
If we change the renewal price, we will email you at least 30 days before it applies, and you can cancel before then.
CounselConfirm the monthly plan exists at launch (it is in the Site's pricing table but not in checkout). Review the auto-renewal disclosures against Georgia's law (O.C.G.A. ยง 13-12-1 and following, 30 to 60 days' notice for terms of 12 months or more) and California's ARL, which is the strictest and applies to California customers: clear and conspicuous terms before checkout, an acknowledgment email, and online cancellation. Confirm the 24-month cap on the two-year term.
7. The Free Tier
Your Screen never turns into a brick. If your Den Family plan ends for any reason, your family moves to the Free Tier, which is free for as long as you own the Screen:
- Keeps working: one Screen (you choose which), the schedule and weather, chores and quests with points, the Calm Corner, and each child's avatar and accessories exactly as they are.
- Pauses: feelings check-ins, notes, the rewards store, team quests, routines, the Dressing Room, and extra Screens, which show a clock only.
- Your history: feelings check-ins and notes stop being shown. You can download them for 90 days, after which we delete them, as our Privacy Policy explains.
- Updates: the Free Tier receives security and bug fixes but not new features.
You can come back to Den Family at any time from the App, and everything that paused switches back on.
8. Hardware warranty
We warrant that your Screen will be free from defects in materials and workmanship for one year from delivery. If it fails under normal home use during that time, email us and we will repair or replace it at no cost, including shipping both ways. This warranty does not cover damage from drops, liquids, power surges, misuse, or opening the case, and it does not cover normal wear.
This is a limited warranty. It gives you specific legal rights, and you may have other rights that vary by state. Any implied warranties, including merchantability and fitness for a particular purpose, are limited to the one-year term to the extent the law allows. Some states do not allow limits on implied warranties, so this limit may not apply to you.
CounselSet the warranty length (one year is a placeholder), confirm the exclusions, and check the wording against the Magnuson-Moss Warranty Act and Georgia UCC Article 2. If the Screen is sourced from a manufacturer with its own warranty, decide whether to pass it through.
9. Your account and your family
- Give us accurate information and keep your email address current, because renewal reminders and alerts go there.
- Keep your password private. You are responsible for what happens under your account.
- You may invite other grown-ups into your family. Each one can see and change the family's information, including children's check-ins and notes. Invite only people you trust with that.
- You are responsible for what you enter about children and for having the right to enter it. If a child in your home is not yours, make sure their parent or guardian agrees.
- Pair Screens only to your own family. A Screen shows a pairing code; keep it to yourself.
10. Acceptable use
The Den is for a household's own use at home. You agree not to:
- use The Den in a way that could harm, shame or endanger a child, or to monitor a child you have no right to monitor;
- resell, rent or lend the service, or use it in a school, daycare or business without our written agreement;
- take apart, modify, jailbreak or reverse engineer the Screen or its software, or install other software on it;
- probe, scan or test the security of our systems, or try to reach another family's data;
- use automated tools to access The Den, or interfere with how it works for others;
- break any law while using The Den.
CounselReview the acceptable-use list and whether a commercial or classroom license should be offered rather than prohibited.
11. Software, updates and license
You own your Screen. The software on it, the App and the Site are licensed, not sold. We give you a personal, non-transferable license to use them with your family for as long as you follow these Terms. We keep all rights in The Den, its software, designs, artwork and names.
On Den Family, Screens update themselves automatically with new features and fixes. On the Free Tier, Screens receive security and bug fixes only. Some updates may be required for the Screen to keep working with our servers.
If you sell or give away a Screen, delete your family from the App first (or remove that Screen), so the new owner can pair it to their own family. Den Family does not transfer with the hardware.
12. Your family's content
Everything your family puts into The Den (names, chores, quests, notes, check-ins, avatar choices, schedule items) stays yours. You give us permission to store, process and display it only to run The Den for your family, as described in our Privacy Policy. We never sell it, never use it for advertising, and never use it to train AI.
You can download it or delete it at any time from the App.
13. Privacy
Our Privacy Policy explains what we collect, how we use it, and how we keep children's information safe under COPPA. It is part of these Terms. Buying a Screen and creating a family account is how a grown-up gives the permission COPPA requires for the information The Den collects about children in the household.
14. Ending the service
By you. Cancel Den Family at any time (section 6), or delete your family in the App to end everything. Deleting your family erases its data and cancels any subscription.
By us. We may suspend or end your access if you break these Terms, if a payment is charged back, or if the law requires it. We will tell you why unless the law prevents it. If we end your access for a reason that is not your fault, we will refund any unused part of your current term. We may also retire The Den altogether; if we do, we will give you at least 90 days' notice, keep the Free Tier running for that period, and let you download your family's data.
CounselDecide what we commit to if the service ever shuts down (notice period, any hardware refund, and whether the Free Tier can be kept running offline).
15. Disclaimers and limits on liability
The Den is a household tool for routines, chores, feelings check-ins and calm. It is not a medical, mental-health, safety or supervision device, and it does not replace a grown-up's judgment or care. If you are worried about a child's wellbeing, talk to a professional.
Except for the hardware warranty in section 8, The Den is provided "as is." To the fullest extent the law allows, we disclaim all other warranties, express or implied. We do not promise that The Den will always be available or error-free, though we work hard to keep it so.
To the fullest extent the law allows, Digital Den Studios will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data that you could have downloaded, arising from The Den. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including for death, personal injury, fraud, or rights under consumer protection laws that cannot be waived.
You agree to cover us for claims and costs that arise from your breach of these Terms or your misuse of The Den.
CounselReview the disclaimers, the liability cap and the indemnity scope for a consumer product sold to families, including the medical and safety disclaimer.
16. Disputes and governing law
Talk to us first. Email hello@digitalden.studio and we will try to sort it out within 30 days.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute that we cannot resolve together will be brought in the state or federal courts in Fulton County, Georgia, and you and we agree to their jurisdiction. You may bring a claim in small-claims court where you live if it qualifies.
CounselChoose between court (as drafted) and binding arbitration with a class-action waiver, and set the venue accordingly. If arbitration is chosen, the clause needs a 30-day opt-out and a conspicuous notice at checkout.
17. Changes to these terms
We may update these Terms as The Den grows. If a change matters to you (for example, prices, renewal terms, the refund guarantee, or your rights), we will email the grown-ups on your account at least 30 days before it applies. Keeping Den Family or using The Den after that date means you accept the change. If you do not, cancel before it applies. The date at the top always tells you when these Terms last changed.
18. A few general things
- These Terms and the Privacy Policy are the whole agreement between you and us about The Den.
- If a court finds part of these Terms unenforceable, the rest still applies.
- You may not transfer your account or these Terms to anyone else. We may transfer them to a company that takes over The Den, and we will tell you if we do.
- If we do not enforce a term right away, we have not given it up.
- Notices to you go to the email on your account. Notices to us go to the address in section 19.
